Texas Deductible Law HB 2102 Explained

Important Update for Homeowners: Understanding the new Texas Roofing Law can save you from confusion and ensure your roof replacement is handled legally and professionally.

1. How Insurance Pays for a Roof Claim in Texas

Most Texas homeowners have a Replacement Cost Value (RCV) policy. Insurance pays in two steps:

Step 1 — ACV Payment (First Check)

  • Depreciated value of the roof

  • Paid immediately after the adjuster writes the estimate

Step 2 — Depreciation (Second Check)

  • Withheld amount

  • Released after repairs are completed

  • Requires a contractor invoice showing the actual cost of repairs

Important:

Insurance only pays the actual cost of repairs. If the job costs less than the estimate, the insurance company reduces the payout. Homeowners do not keep the difference on an RCV policy.

2. Texas Deductible Law (HB 2102)

Texas law requires homeowners to pay their deductible. It is illegal for any contractor to:

  • Waive the deductible

  • Pay the deductible

  • Rebate the deductible

  • Hide the deductible in the estimate

Insurance companies require proof of deductible payment before releasing depreciation.

3. Why Homeowners Cannot Keep Extra Insurance Money

Texas follows the principle of indemnity:

Insurance restores your home to pre-loss condition — it does not allow profit.

If a contractor gives a cheaper estimate, insurance will:To change and reuse text themes, go to Site Styles.

  • Lower the total payout

  • Reduce or eliminate depreciation

  • Only pay the actual repair cost

This applies even when subcontractors are used.

4. When Homeowners Can Keep Savings

There are only three legal exceptions:

  • ACV-Only Policy — No depreciation; homeowner may keep savings.

  • DIY Repairs — If the policy allows it, labor savings may be kept.

  • Small leftover amounts — Some carriers do not reconcile tiny differences.

5. How Amerishield Uses Subcontractors (Full Transparency)

Amerishield uses certified subcontractors — standard practice in Texas roofing.

Homeowners Are Fully Protected Because:

  • Amerishield pulls the permit

  • Amerishield provides the warranty

  • Amerishield carries the insurance

  • Amerishield manages and supervises subcontractors

  • Amerishield is responsible for the entire job

Subcontractors are labor working under Amerishield’s license and insurance.

Insurance pays based on Amerishield’s invoice — not the subcontractor’s rate.
